Brief Description
As a disabled person, who uses inline skates as a specialty wheelchair (http://www.handicapskater.com) and won a ruling against the US Department of Transportation with the US Department of Justice in 2007, I have a unique disability that has been misconstrued for 30 years now. This incident is one demonstrating my difficulties with Employers pertaining to access for my employment.
- 1/1 – Signed Contract to start on this day and had prepared, however there was such disorganization that it was postponed to 1/18. (Ref. HandicapSkater-EverythingD-1-1.pdf)
- 1/11– Provided a list of 4 reasonable accommodation requests to EverythingD for work with Accenture for AirBnB, demonstrated in the email chain Ref: HandicapSkater-AirBnB-Email-[1-5].pdf
- I use inline skates as a specialty wheelchair and would be usable with a wheelchair standard of use. Only action required is acknowledgement that its use is ADA compliant.
- I use a 6 foot staff to facilitate and ensure appropriate mobility. I will provide it and leave at my desk.
- A special desk chair that I am providing.
- A desk with an approximate height of 48 inches to limit bending down for my disability. Nothing elaborate, it will always stay at the same height.
None, of these accommodations cost AirBnB a penny, since they provide sit to stand desks and the first three are conceptual in nature only.
- 1/18 – Dropped off my special desk chair at AirBnB headquarters, where I was confronted by Security not to wear my specialty wheelchair (inline skates). I provided my documentation, 1 Dr’s note with Biomechanics professional diagnosis (Ref: HandicapSkater-DrNote.pdf), 2 reasonable accommodation requests approved for San Mateo (Ref: HandicapSkater-SM-RA.pdf) and San Francisco Superior Courts (Ref: HandicapSkater-SF-RA.pdf). The security officials requested to copy my notes, which I gave them permission.
- 1/22 – Started working at 650 7th Street, where there are 5 steps (650 7th St) to enter the premises. I inquired the first day about a handicap accessible entrance and the front desk made a call about it, I told them that I was just inquiring not complaining. Their resolution was to get a key to enter a special entrance, which means it is not prudent for accessibility. I voluntarily accepted traversing the stairs with my prosthetic, safely using my 6 ft staff for stability. Furthermore, there were two steep inclines in their other building (888 Brannan St), where I used my staff and a special way to handle it that they would not accept. I have spent 20 years using my specialty wheelchair in businesses without incident. Here are references to my first note establishing skates cooperatively with Target, then agreements with 2 employers: Visa and Cisco Systems and a last email explaining harassment that I deal with for riding my Motorcycle. - 1/22 thru 1/31 – I worked everyday using the stairs for 2 weeks with my inline skates without incident.
- 1/31 – A dog tried to bite me at work, where I posted a comment on a slack channel (Ref: HandicapSkater-Dog-FromMyDesk.JPG, HandicapSkater-Dog-Closeup.JPG). Less than 2 hours later I was told that AirBnB needed my disability documentation, which I had already provided on 1/11 and 1/18 (Ref: HandicapSkater-AirBnB-Email-[1-5].pdf). Furthermore, they stated that I was not allowed to use my specialty wheelchair on AirBnB property and to work from home, because I was now determined to be a safety risk, not the dog.
- 2/1 – AirBnB did not give me 24 hours notice for me to change my ParaTransit ride to work and my physical therapy later that night, so Accenture let me work from their office.
- 2/2 thru 2/28 – I worked from home for a month, where it was difficult to understand 2 principle players’ accents over the phone for the software I was working on and I was not included in all of the meetings. At the end of February, I resigned on the grounds of inaccessibility because I could not continue getting the work done remotely (e.g. Ref: HandicapSkater-AirBnB-Email-3.pdf page 2, notifying me of meetings beside the scrum that I was not given any info) and AirBnB sent a letter with provisions that made my specialty wheelchair untenable. They were regressing the progress that I have made over 30 years! (Ref: HandicapSkater-DFEH-Ruling.pdf, HandicapSkater-DOJ.pdf, HandicapSkater-DOT-FTA.pdf)
- 2/19 – I received AirBnB’s provisions through EverythingD for using my specialty wheelchair. These are some of the same provisions that I had established with Target in 1999 as a customer (Ref: HandicapSkater-Target-RA.pdf). Furthermore, I have worked and used my specialty wheelchair at Cisco Systems, NASA, AKQA, Hitachi, Zynga, SaaSMarkets, ICIX, Visa, Google and Uber, since 2005 (Ref: HandicapSkater-VISA.pdf, HandicapSkater-Cisco.pdf, HandicapSkater-SaaS-Parking.pdf). Similar issues have arisen at these jobs obviously, but I have always been able to get a competent resolution. I submitted my resignation letter on discrimination grounds.
- 2/21 AirBnB deadline to respond to their provisions.
- 2/28 Last working day for EverythingD to do work for Accenture and AirBnB.
Additional Details
I was working at AirBnB as a contractor through Accenture with EverythingD where I was using my specialty wheelchair, inline skates, for two weeks without a problem and had given a reasonable accommodations request for my specialty wheelchair to facilitate understanding. I have a list of emails (Ref: HandicapSkater-AirBnB-Emails-[1-5].pdf), a picture of the dog (Ref: HandicapSkater-Dog-FromMyDesk.JPG, HandicapSkater-Dog-Closeup.JPG) that tried to bite me on the day they requested me to work from home. My intention was to resolve this ADA complaint amicably, but I never received the necessary cooperation.
Resolution
My purpose was to establish a protocol, so I do not have to go through this ever again. In 2005, I petitioned the US DOT by establishing a protocol with a Dr’s note and Biomechanics Professionals note to prove the viability of my inline skates as a disability aid. At this point, I am pursuing EverytihngD and Accenture’s negligence in providing appropriate accommodations for AirBnB’s blatant discrimination. Furthermore, AirBnB does not have an appropriate handicap entrance for building 650 7th St and 888 Brannan St has at least 2 inclines that are too steep for handicap accessibility, where I was told someone had died using skates down one ramp.
Conclusion
I have been denied work, because of my disability and threatened. I am 52 years of age and need this discrimination to stop. I had a contract with Twitter, August of 2019, through Data Piper (Google Cloud Partner) and I dropped my chair off, a week later they told me to pickup my chair and had cancelled the project. Is the AirBnB incident or specialty wheelchair harming my ability to get jobs?
I had another employer, Facebook, that was eager to meet with me after a 6 week interview process, but when I showed up on skates they passed on my candidature after successfully completing 2 interviews for 45 minutes writing Python and SQL code that the interviewers admitted was algorithmically correct. I do not know that Facebook was adversely influenced by my skate usage, but the question is still there.
